The Debate in Los Angeles Over Charter Schools

The vote that received far more attention, drawing hundreds of protesters and hours of public comment, was more symbol than policy: a resolution calling on the state to enact a moratorium on new charter schools while studying their impact. 
The resolution has no legal impact; only the State Legislature has the authority to enact a moratorium or any other strict limits on charter schools. Ever since the deal was announced, charter school supporters have been playing defense, making a huge effort to persuade the school board to defeat the resolution. Such a defeat would have undermined Austin Beutner, the superintendent, who has consistently said he supports charter schools, but was willing to agree to the side deal on charter schools to end the strike. 
“I do support strongly school choice for families and recognize charter schools are one of the options for a high-quality education,” Mr. Beutner said before the vote. “There is nothing in this resolution to close any existing charter schools or reduce the many choices available to families.”

NEA Joins Call for Moratorium on Charter Schools

This week, the nation’s largest labor union, the National Education Association, broke from its cautious regard of charter schools to pass a new policy statement that declares charter schools are a “failed experiment” that has led to a “separate and unequal” sector of schools that are not subject to the same “safeguards and standards” of public schools.
To limit the further expansion of these schools, the NEA wants a moratorium on new charters that aren’t subject to democratic governance and aren’t supportive of the common good in local communities.
The NEA’s action echoes a resolution passed earlier this year by the national NAACP calling for a moratorium on the expansion of charters and for stronger oversight of these schools. These declarations also align with a policy statement issued last year by the Movement for Black Lives, a network Black Lives Matter organizers, calling for a moratorium on charter schools.
Now that labor and civil rights groups have come together in a unified call for a moratorium on these unregulated, privately-operated schools, prominent leaders in the Democratic party can champion this issue knowing they have a grassroots constituency that supports them.
Democrats in states where charters have been the most controversial – such as Ohio, Michigan, Pennsylvania, and California – should be especially interested in leading on this issue for a number of reasons.
Democrats know that success for their party relies on bringing labor and civil rights advocates together on key issues.

Betsy DeVos Will Be an Opponent of Public Education

In “an unprecedented break” from tradition, Democrats in the US Senate are expected to challenge as many as eight of Donald Trump’s cabinet nominees, including Betsy DeVos for US Secretary of Education, according to a report by the Washington Post.
The opposition to DeVos, Politico reports, comes from “more than a dozen Democratic senators from all wings of the party” who “will portray DeVos’ views as being outside the education mainstream.”
The non-mainstream “views” Politico cites include her “bankrolling efforts to create state voucher programs” and to expand a “loosely-regulated charter school sector” in Michigan, her home state. The Senators are “also intent on drawing attention to her lack of experience in a traditional public school setting. DeVos has never worked as a public school teacher or superintendent, nor has she sent her own kids to public schools.”
Opposition to DeVos has brought an outcry from conservative and politically centrist fans of “education reform” who claim opposing DeVos is driven “partisanship” and “nasty,” “personalized” rhetoric.
It’s true that the opposition to DeVos is a radical departure from what’s happened in the past.

Sacramento in the Trump House

Sacramento outgoing   first lady Michelle Rhee and  outgoing Mayor Kevin Johnson met with President-elect Donald Trump on Saturday as Rhee is in contention for education secretary for the incoming Republican administration.

Johnson was unavailable for comment, Strait said. According to the Bee, 
"Rhee gained prominence as an education reformer while she was chancellor of schools in Washington, D.C., from 2007-10. In 2010, she formed StudentsFirst, a states-based education reform organization that advocates for school-choice initiatives and has been active in elections." She has been an ardent opponent of teachers unions and a supporter of efforts such as the defeated Vergara   decision.  ( see prior posts on this blog). She was a significant advisor to the Broad Academy for school leadership which trains and places school superintendents including a former Sacramento Superintendent Jonathon Raymond. Graduates have  advanced a corporate view of school "reform"  in Sacramento, Los Angeles, and around the nation.

How Messed Up is California's Charter School Sector ?

Ohio and Utah are known in education circles for having extraordinarily troubled charter school sectors, and the same is true in  Pennsylvania, where Auditor General Eugene DePasquale issued a report this year and declared his state’s charter school law the “worst” in the nation.
But there is another place with a scandal-plagued charter sector that gets less national attention than it should: California, which has more charter schools and charter school students than any other state in the nation, and where one billionaire came up with a secret plan to “charterize” half of  the Los Angeles Unified School District.
There is a never-ending stream of charter scandals coming from California. For example, a report released recently (by the ACLU SoCal and Public Advocates, a nonprofit law firm and advocacy group) found that more than 20 percent of all California charter schools have enrollment policies that violate state and federal law. A Mercury News investigation published in April revealed how the state’s online charter schools run by Virginia-based K12 Inc., the largest for-profit charter operator in the country, have “a dismal record of academic achievement” but has won more than $310 million in state funding over the past dozen years.

There was the scandal involving a charter school principal who also doubled as a National Basketball Association scout, traveling first class to basketball games around the country — and charging his travel expenses to his charter school. Don’t forget the one involving a charter school that closed in 2014 after state auditors found a number of issues, including indications that administrators funneled millions of dollars in state funds to the schools’ operator and her family and friends.

How Some California Charter Schools Illegally Restrict Enrollment
All across California, charter schools are implementing admissions policies that exclude students from enrolling. Like other public schools, charters must admit all students who wish to attend. By law, they may not discourage certain students from enrolling based on income, national origin, academic performance or other factors. These admission policies threaten to turn public schooling into a two-tier system where the students who need the most resources receive the fewest.
To realize charter schools’ promise of providing educational choice to all, the ACLU SoCal and Public Advocates released “Unequal Access: How Some California Charter Schools Illegal Restrict Enrollment,” a report that sheds light on exclusionary enrollment policies at 253 charter schools. See full list of charter schools cited.
These charter schools post enrollment policies or forms online that are clearly illegal or exclusionary. Other schools may also maintain similar prohibited policies that are hidden from the public view. The violations we found include:
    • Exclusion Based on Academic Performance
    • Discrimination against English Learners
    • Pre-Enrollment Essays or Interviews
    • Requirements that Discourage Undocumented Students
    • Illegal Parent/Guardian Volunteer Requirements

How Long Can Big Money Keep Democrats in the Charter School Camp ?

It’s obvious 2016 is an election year when Democratic candidates need to draw a bright line to differentiate themselves from Republican opponents.

With Donald Trump leading the GOP ticket, and most leaders of his party getting in line behind him, it’s doubtful Democrats will find urgent need to “meet in the middle” on issues such as civil rights, women’s reproductive health and equal pay, immigration, minimum wage, gender equity, and climate change.

There may be some issues that still tempt Democrats to collude with conservatives in order to woo mythological “swing voters.” But the number one fear among top Republican strategists is that Democrats will run “a base campaign, directed toward liberals, maximizing that vote, and electing a devastating ticket.”

How then, do you explain the results of the recent California primary?

A Toxic Mix

As Harold Meyerson recently wrote in an op-ed for the Los Angeles Times, while the Democratic Party’s presidential candidates, Vermont Senator Bernie Sanders and former U.S. Secretary of State Hillary Clinton, ran on populist platforms denouncing “the corrosive role of money in politics” and “condemning the plutocratic consequences of the Supreme Court’s Citizens United decision,” many Democratic Party candidates down ticket funded their campaigns with big money from two corporate interests.

Charter School Advocates Spend Heavily to Gain Control of County Board of Education.

Charter school advocates have spent nearly $300,000 backing candidates for three seats on the board of the Sacramento County Office of Education, positions that once were considered sleepy political outposts.
Besides providing oversight for Sacramento County school districts, the education board reviews the charters of countywide charter school systems and hears appeals from charter schools whose applications have been rejected by local school districts.
In recent years, the California Charter Schools Association has emerged as a major player in supporting candidates for the board. This year, the advocacy group has focused its donations on three candidates: Joanne Ahola, who works for the association; Heather Davis, who is married to Elk Grove Mayor Gary Davis, an employee of the charter schools group; and Roy Grimes, a former county education board member challenging an incumbent who has voted against reauthorizing charter schools.
Carlos Marquez, senior political director for the Charter Schools Association, said it views the Sacramento County Office of Education as “a really strong safeguard, a strong backstop for (preventing) politically motivated denials (of charter schools) at the local level.”
“We are happy with the board,” he added. “It’s really important right now that we maintain continuity.”
The county Office of Education has so far chartered five schools – all part of a network operated by Margaret Fortune that focuses on closing the achievement gap between African American and other students. Fortune recently finished serving as a California State University trustee and was an adviser for former Govs. Arnold Schwarzenegger and Gray Davis.

A very conservative group has controlled Michigan since the election of Governor Rick Snyder and a Republican majority in its legislature in 2011. At the heart of their policies has been a concerted effort to remove control over cities and communities by the people who live in them, and to impose austerity and free market measures on populations who are mostly African American and people of colour.
Some of the key opponents to that threat to democracy, however, have been Detroit's teachers. This January, the Detroit Federation of Teachers filed lawsuit, and some educators even staged a walkout of the city's schools, to protest against the "deplorable, dangerous, unhealthy and unacceptable" conditions for children that have emerged from the wreck of Michigan's autocratic rule.
The key to the conservative's strategy has been the emergency manager law. While a version of it was passed in 1988 under a Democratic administration, new Republican office holders passed Public Law 4 in 2011, which was much more radical. It gave virtually unlimited powers to unelected managers appointed by the governor in times of financial distress, while elected city councils and school boards lost all decision-making power.
With none of the constraints of public accountability, emergency managers in several cities then proceeded to nullify union bargaining agreements and sell off public assets. Detroit itself was forced into bankruptcy in July 2013.
In nearby Flint, Governor Snyder appointed Darnell Earley as emergency manager in October 2013. Over the next 16 months, Earley laid the groundwork for switching Flint's water supply from the municipal utility that serves Detroit to pumping water from the Flint River - a waterway that is highly-polluted as a result of decades of toxic waste dumping by auto plants and other heavy industry.
Earley, a Democrat, justified the move as a measure to reduce costs. It has since become clear, however, that his action was connected to a plan to drive Detroit even further into bankruptcy.
The Detroit Water and Sewerage Department has operated with budget deficits that averaged US$57 million a year; debt servicing took up half of its budget. Bondholders, facing the loss of Flint as a customer, pressured for cutting off delinquent customers and raising rates to avoid writing down their investments in bankruptcy proceedings. The French waste and water management multinational, Veolia, was waiting in the wings.

When Detroit's water agency offered to halve its rates to keep supplying the city, Earley and his successor refused. Instead they signed an agreement to put Flint into the hands of a new water supplier connected to Veolia.
Without Flint as a customer, Detroit residents now have to pay higher rates. Detroit itself may have to sell its public water system - one of its main assets - to private investors.
One year ago, under the decree of Detroit's emergency manager Kevyn Orr, the water district began to shut off water services to poor residents behind on their bills. Only a global outcry stalled the move. At the same time Orr began negotiations with Veolia.
In February 2015 Veolia was then hired by Flint to study its water, after the switch in sources had been made. Public health doctors were already warning state and federal authorities that the level of lead in the drinking water pumped from the Flint River was alarmingly high. Lead is a recognised cause of learning disabilities in children, and the damage to their cognitive development is permanent.
Veolia announced that Flint's water was safe. It echoed similar false safety claims by the Michigan Department of Environmental Quality, an agency under the control of Governor Snyder. However, last year even General Motors stopped using Flint water in its car manufacturing plant because it was causing corrosion.
Eventually Snyder was forced to admit that corrosive river water was dissolving the lining of Flint's ancient lead pipes, causing a spike in the metal's concentration.
Embarrassing emails revealed knowledge by state authorities of the lead contamination, at the same time they were ridiculing parents and public health officials who warned of the danger.
Eventually a state of emergency was declared, and President Barack Obama offered US$80 million in relief, although replacing the city's pipes is likely to cost over US$1 billion.

After leaving Flint, in January 2015 Earley was appointed by Governor Snyder as emergency manager of Detroit Public Schools (DPS) - the system's fourth emergency manager in seven years.
The main program of all four has been the privatisation of Detroit schools. By the end of the 2009-2010 school year, 36 per cent of students (50,139 students) were already attending private charter schools, and another 41 schools (30 per cent of the district serving 16,000 students) were converted into charters.
The Deficit Elimination Plan - agreed between managers and the state of Michigan in a bid to erase DPS' US$20.4 million deficit by the end of 2021 - required the district to close a further 70 schools over two years, and raise class sizes to 60 students at high school level.
Voters rebelled and repealed Public Law 4 in the 2012 election. The legislature moved even further to the right, however, passing a law forbidding contracts that require union membership as a condition of employment (a so-called "Right to Work" law), and then passed Public Law 4 again in a slightly modified form, as Public Act 436.
In a recent opinion piece, Pamela Pugh, treasurer of the (elected) State of Michigan Board of Education, wrote: "After more than six years of a failed state takeover, Detroit Public Schools have deteriorated into a destabilised education system, marred by decreased academic outcomes and increased deficit, upward of US$3.5 billion. Just as Flint's water crisis occurred under emergency management, so did the demise of the Detroit school district."
Last month, the Detroit Federation of Teachers finally filed a lawsuit to force Earley to resign, and to return the schools to control by an elected school board. "Asking a child to learn or a teacher to instruct in classrooms with steam coming from their mouth due to the cold in the classroom, in vermin-infested rooms, with ceiling tiles falling from above and buckets to catch the rainwater, or in buildings that are literally making them sick, is more than what is legally or constitutionally tolerable", the suit says.
Other conditions named in the action include black mold, bacteria, freezing cold or boiling hot classrooms, rats and insects, exposed wiring and falling debris.
At the beginning of this February Earley finally resigned, telling Governor Snyder he'd completed his work of "comprehensive restructuring" months ahead of schedule. And as hundreds of teachers staging a'sickout'rallied in front of the school district offices, Snyder announced he'd appoint a 'transition leader' to move the schools back toward local control.
"Educators and parents have been raising the red flag for years about dangerous school conditions, only to be snubbed, ignored and disrespected by DPS and the emergency managers, including Earley", said Ivy Bailey, interim president of the Detroit Federation of Teachers, in a statement. "The state has brought the school district to its knees, and now it's time to give up the reins."
Michigan cities like Detroit and Flint have been used as a laboratory for market-based policies and the most extreme forms of austerity. The results have been deadly.
Detroit remains in bankruptcy and emergency managers still wreak havoc in several other cities. Detroit schools, even without an emergency manager, will take many years to recover from the devastation caused by disinvestment and privatisation. The water in Flint still has lead, and the children damaged by its pollution will never fully heal.
As Americans go to the polls to vote this year, they must remember that conservative candidates all over the country are proposing to extend policies like those enacted in Michigan. The actions of politicians shouldn't just be debated in the abstract; when people are forced to suffer the very real consequences of political negligence such as that wrought on Flint and Detroit, individuals must be held to account.

Charter Schools Fuel Inequality and Hinder School Reform

Charter school interests led by the Broad Foundation have recently unveiled an expansion plan called “The Great Public Schools Now”. This plan is proposing a huge increase of privately operated schools within the Los Angeles School District with the creation of 260 new charters during the next eight years at a cost of 490 million-dollars. The approval and implementation of such a plan would eventually double the number of LAUSD students attending privately operated charter schools and this would comprise almost half of the LAUSD’s students. According to this plan such a massive expansion of charters would also require the services of about 5000 teachers to staff these new schools, however, the

proposal makes no mention of recruiting any teachers presently employed by LA Unified who are unionized and generally more experienced. Instead, this Broad Foundation plan proposes to hire recent college graduates as its instructors who will be trained by ‘Teach for America’and other private groups. These young college graduates and prospective charter teachers are generally inexperienced, paid less and non-union, all of which keep business costs down for the privately operated charters. If the Broad plan is approved and implemented, this loss of tens of thousands of students to these new charter schools could possibly result in the elimination of  thousands of jobs for LA District’s teachers, administrators and non-teaching employees. The reaction of the present school board to this proposal has been mixed. Charters are businesses that privately operate public schools and use public school sites and tax monies to fund their for-profit operations. The first privately operated LAUSD charters were created and approved during the 1990’s by the school board which was under heavy pressure to reform the District’s schools. The Board’s rationale for this action was that the charters could provide a choice for parents and students to attend a school with a better educational program or a safer campus instead of their traditional home school. Rather than comprehensively reform and fix the regular schools at that time, this critical Board decision to approve charters would create an escape valve for academically motivated students to eventually leave their traditional campuses and open the door to a steady increase over the years in the privatization of the District’s public schools. In addition to the charter schools, the LAUSD had already created magnet schools during the 1970’s as a result of an earlier anti-segregation lawsuit filed against the District called “Crawford vs Board of Education, Los Angeles”. This successful lawsuit compelled the District to integrate its students and subsequently magnet schools for voluntary integration were created as a means to do so. These special magnet integration programs offered programs in science, math or other specialties in order to entice white parents to enroll their children into these integrated schools and thus bring the LAUSD into compliance with the Crawford court order. After almost four decades, these specialized magnet schools many of which are for gifted students, still exist even though their original intent of integrating large numbers of students is no longer feasible as white flight and a change in demographics have left the LAUSD student population at over 85 percent minority. Both tiers of Magnets and charters also have the benefit of being able to carefully select the students that they admit.

Last week the Los Angeles Times obtained a secret 44-page proposal drafted by the Eli and Edythe Broad Foundation and other charter advocates, that according to one critic would "do away with democratically controlled, publicly accountable education in LA." With the aid of a billionaires’ club of supporters, the plan is designed to charterize 50% of LA public schools.

A California billionaire is enlisting other wealthy backers in a $490 million scheme to place half of the students in the Los Angeles Unified School District into charter schools over the next eight years—a plan at least one critic says would "do away with democratically controlled, publicly accountable education in LA."
The Los Angeles Times obtained a confidential 44-page proposal, "The Great Public Schools Now Initiative," drafted by the Eli and Edythe Broad Foundation and other charter advocates.
"Los Angeles is uniquely positioned to create the largest, highest-performing charter sector in the nation," the executive summary reads. "Such an exemplar would serve as a model for all large cities to follow."

After nearly a year of deliberation, the state Supreme Court ruled 6-3 late Friday afternoon that charter schools are unconstitutional, creating chaos for hundreds of families whose children have already started classes.
The ruling - believed to be one of the first of its kind in the country - overturns the law voters narrowly approved in 2012 allowing publicly funded, but privately operated, schools.
The latest: 2 charters say they will stay open this year despite ruling
Eight new charter schools are opening in Washington this fall, in addition to one that opened in Seattle last year.
It was not immediately known what would happen with the schools that are already running. The parties have 20 days to ask the court for reconsideration before the ruling becomes final.
In Seattle, Summit Sierra, a new college-prep high school, opened Aug. 17 in the Chinatown International District with its inaugural freshman class of 130.
"We will absolutely be here ready for kids on Tuesday," said Executive Director Malia Burns.
School also started Aug. 17 at SOAR Academy and Summit: Olympus in Tacoma. Excel Public Charter School in Kent began Aug. 20, and Destiny Charter Middle School in Tacoma opened Aug. 24. Rainier Prep's first day of class was Tuesday.

How the Ruling Class Remade New Orleans and Its Schools

It’s one of those ironies that New Orleanians tend to especially appreciate. Today, on the tenth anniversary of the failure of the federally maintained levees, the keynote speaker at the annual Rising Tide Conference on the Future of New Orleans will beDeRay Mckesson [1].
Presumably, Mckesson’s invite was the result of his impressive work publicizing Black Lives Matters issues and protests across the country in the past year. But before McKesson became an activist in that movement, he was a standard-bearer for Teach For America and the New Teacher Project — education “reform” organizations that played a crucial role in aiding and abetting the destruction of New Orleans’ black middle class and propagating a pedagogical philosophy [2] that apes the worst of culture of poverty [3] rhetoric.

Such seeming incongruities are rampant this month in New Orleans, as they have been for the last ten years. Developers, urban planners, corporations, nonprofits, self-proclaimed activists, politicians, education “reformers,” hip consumers, middlebrow magazines, anarchists, urban farmers, bicycle enthusiasts, authenticity seekers, and “change agents” continually celebrate the city’s supposed rebirth, resilience, reform, rebuilding, re-whatever.
But it’s worth stepping back to consider whether such ironies are truly ironic, or rather just symptomatic of a larger condition that has plagued New Orleans — and the rest of the nation — over the past decade.
Since the levee failures, New Orleans has been ground zero for what on its face looks like a diverse cohort seeking to use the Katrina-produced “blank slate [4]” as a canvass [5] on which to enact their vision of twenty-first century reform. Black and white, gay and straight, wealthy and riddled with student debt, seventh-generation New Orleanian and recent Brooklyn-migrant, Republican and anarchist — little to nothing at the level of what the cultural studies aficionados might call positionality unites them.
Dig deeper though, and they share certain commonalities, commonalities integral to the only positionality that matters in the context of Katrina’s devastation and the resulting ten years of dislocation and upward redistribution of wealth: their political commitments and actions.
Indeed, what appears to be a motley group with every conceivable background and ascriptive subjectivity is, upon closer inspection, a class. It is a class well past the point of consolidation and one whose prerogatives have indelibly shaped the city’s rebuilding — dictating for whom New Orleans has and has not been rebuilt, all the while postulating and profiting from an ahistorical construction of authenticity, organic community, and ascriptive affinity as the basis for representation.
Mckesson is a particularly interesting case because he crystallizes these issues so well. One may ask how a dogged determination to end police violence against African Americans can be reconciled with a vision of education reform that cares nothing for questions of structural political economy, school funding, or the control of teachers over their classrooms, and instead supposes that the problem is that not enough teachers come from elite Northeastern colleges and universities; too many of them are old, lethargic, and evidently devoid of that pinnacle of neoclassical economics, “human capital”; and that poor students need to be cured of their Moynihan [6]-style tangle of pathologies.
The answer of course, is that they are not incompatible at all.
A deep and abiding commitment to dismantling a heavily militarized criminal-justice infrastructure does not necessitate that the committed individual oppose a national attack on democratic control over schools, the devaluation of teachers and their labor, an emphasis on market choice as a solution to structural inequality and disinvestment, or a base-level assumption that poverty and inequality are the results of damaged psyches and behavioral traits supposedly endemic to poor communities.
Instead, Mckesson’s appearance in New Orleans is a perfect encapsulation of the city’s last ten years. The “grand experiment” perpetrated on New Orleans teachers, students, and schools has always been done in the language of social justice, antiracism, and multiculturalism.
So has the broader grand experiment of the “new” New Orleans. New Orleans has not just been reconceived and reimagined — it has been rebuilt to serve and further specific material and ideological interests. It is a city increasingly designed not to produce equality but to give opportunity to the “worthy” while driving out [7] as many “unworthy” as possible. (The exception of course being those needed to staff the low-wage hospitality [8] and service industry, along with those whose labors [9] produce the city’s appeal as something timeless and supposedly outside the market and the profit motive — an appeal that is one of market culture’s most valuable commodities in contemporary capitalism.)
Any serious reckoning with the last ten years must start with the following facts about post-Katrina New Orleans.
Approximately 100,000 people, mostly African American, have not returned to the city. Real-estate values have doubled, tripled, and even quadrupled in some neighborhoods; rents have more than doubled in many neighborhoods; and the city’s public housing, well-built and largely unaffected by the floodwaters, has been turned over to private developers [10] and razed in favor of mixed-income complexes designed to eliminate the supposed pathologies of the poor while making developers a handsome profit. Meanwhile, countless publicly owned properties have been gifted to high-end, well-connected developers for a song.
Wages have stagnated to the point where the city is the second most unequal in the nation. Public transportation [11] is even more nonexistent than before the flood (no small feat).
Much-touted education “reform” has proven unsuccessful [12] even when judged by its proponents’ favored metric, high-stakes standardized tests, and has both incentivized schools to give up on the city’s most disadvantaged children and produced a generation of New Orleanians educated with the sole purpose of passing a standardized test. Effected through the mass firing [13] of veteran African-American teachers, the decimation of the traditional public school system also eviscerated the city’s black middle class. And finally, the removal of education policy from democratic control placed it in the hands of a variety of corporate-backed organizations.
University of New Orleans — a once-proud public university that regularly educated between 15,000 and 17,000 largely working-class students a year and produced cutting-edge research across various fields of human inquiry — has been so hollowed out that the very question of its continued existence is a cruel parlor game played every year by faculty and a student body cut nearly in half.
Of the $6.4 billion that was to be distributed [14] by the private infrastructure consultancy firm ICF International to help homeowners rebuild, only $1.5 made it to residents. Meanwhile, ICF’s stock price has almost tripled. The money that did reach residents was doled out in a manner reminiscent of redlining, increasing capital in the hands of the wealthiest New Orleans property owners — disproportionately white — while decreasing it in the hands of the poorest —disproportionately black. Not a cent was allocated at any level for renters to return, nor were any rental market controls put in place to aid in their homecoming.
The Avondale Shipyards [15], which paid middle-income wages and was formerly the region’s largest private employer, unceremoniously closed its doors in 2013 after suffering a slow and hardly noticed death.
perfectly functional hospital [16] that was an important symbol of local identity and provided the city with a strong tradition of low-income and indigent care wasn’t reopened after the storm. Yet the city bulldozed a relatively unflooded, working-class neighborhood and spent $1.1 billion to build a shiny new hospital on the promise that it would attract high-income employees from out of state — whose income would, they insisted, trickle down.
The majority of the direct producers of New Orleans’ vaunted culture — its musicians, artists, culinary workers — make poverty wages. An even greater majority of their support staff — the dishwashers, bartenders, taxi drivers, maids, etc. who provide the labor infrastructure for New Orleans’ culture to be sustained — live on well below poverty wages.
Louisiana continues to lead the nation in incarcerated residents, the majority of who do their time in for-profit prisons. New Orleans has effectively criminalized [17] homelessness even while its percentage of homeless residents has risen to the second highest in the nation. The list could go on and on.
The political and social divisions that exist within the city are not simply red herrings that obscure the causes of this growing dislocation. The divisions themselves are the legitimating agents of this inequality.
To put it bluntly, New Orleans has become a tremendously profitable model city for global capital. Yet the lines of debate within the city virtually never break down along the question of who stands to make money and who stands to be further disenfranchised.
Equally as problematic, the grand experiment itself has furthered the ideological hegemony of this expropriation well beyond the confines of Orleans Parish. Countless self-identified liberals, progressives, and social justice advocates around the country and the world tout the city as the exemplar for education reform, film tax incentives, the development of a cultural economy, corporate-backed non-profit solutions to social problems, entrepreneurial culture, and such revolutionary developments as locally produced food, DIY art projects, and resistance through performance and consumer culture.
It is in this manner that New Orleans’ new ruling class has come to govern with absolute hegemony.
Homages to culture and culture-bearers; neighborhood and cultural preservation as end-goals; emphases on proportional racial representation, whether on the city council or in victimhood at the hands of terroristic police; social entrepreneurship, the notion of “doing well by doing good,” and “social justice” outsourced to corporate-backed nonprofits; advocation of urban amenities like bike lanes and locally sourced food markets; even taking down white supremacist monuments and renaming streets bearing the name of treasonous insurrectionists — all of this is perfectly compatible with the dislocations and expropriations of the last decade.
Indeed, these gestures are not simply compatible with the status quo, but serve to refract dissent and contentious politics into questions of subjectivity and identity that in fact provide a bulwark for the prerogatives of New Orleans as a city increasingly divided between those who it has been purposely rebuilt for and those who it has manifestly attempted to exclude.
More than anywhere else in the last ten years of American history, New Orleans exemplifies how equality and justice become functions of equitable distribution along lines of race, city nativity, gender, etc. — rather than evils to be defeated in and of themselves.
Charter school hucksters like Louisiana Superintendent of Education John White and millionaire businesswoman Leslie Jacobs; multi-millionaire developer and destroyer of public housing Pres Kabacoff and his legion of aspirants [18]; politicians ranging from former mayor Ray Nagin to current mayor Mitch Landrieu, along with the vast majority of the city council; former city councilman Oliver Thomas (who famously hoped to rid the city of “soap opera watchers” following the flooding); musical ambassador and public library embezzler [19] Irvin Mayfield; Teach for America and the New Teacher Project; actor, organic food provider-cum-profiteer, and would-be real-estate developer [20] Wendell Pierce; virtually every neighborhood association in the city; urban planning and revitalization groups from the local St Claude Main Street to the national Urban Planning Institute; elite interest groups like Tulane University, New Orleans Tourism Marketing Corporation, and Downtown Development District; countless more minor nonprofit hacks and wannabe power brokers.
All have played, and love to play, the game where justice and equality are defined along the lines of representationality, diversity, and multiculturalism.
It’s an easy and profitable game for them to play. Far too often, though, it’s also an easy game for the rest of us to play. We proclaim ourselves resilient. We speak of a rebirth. We glorify resistance through the market. We proclaim our culture and neighborhoods transhistoric and emphasize imagined forms of authenticity. Wecelebrate [21] groups disconnected from conceivable institutional power mechanisms demanding equitable representation.
Our politics — in New Orleans and all across nation — becomes about morality tales of injustice based on subject position, racial representation, or authentic embeddedness in some imagined organic community. It fails to recognize the cause of these injustices — the profit motive and a dire lack of institutional means to curtail it. And at the end of the day, it reinforces the rules of a game that at best allows for a more equitable distribution of inequality.
